Recent measures to reduce patent backlog in Brazil have taken place

On December 1st, 2019, the Brazilian PTO has broadened the Patent Prosecution Highway (PPH) Programs to include all areas of technology.

Therefore, Applicants are able to expedite the patent prosecution and increase chances of allowance of all fields of inventions.

With the PPH, after a Patent Office considers the subject matter of a patent application patentable, it becomes possible to prioritize the patent application of the same invention and Applicant at the Brazilian PTO.

On April 1st, 2020, the Brazilian PTO started the PPH pilot project with the Korean Intellectual Property Office (KIPO).

The PPH with South Korea will expire on March 31st, 2025, also being valid for all technological fields and within the limit of 400 requests per year, according to Resolution PR No. 252 of 2019.

So far, the PPH program totaled an agreement with 20 countries (including the USPTO, JPO, UKIPO and PROSUL), in addition to the European Patent Office (EPO).

Please note that the Brazilian PTO will accept a limited number of PPH requests per year, and per month cycle.
